The Electronic Communications Privacy Act (ECPA) was intended to secure the confidentiality of Americans’ communications. For this reason, the law is not applicable outside the United States as countries have their privacy standards. Thus, the plaintiffs do not have the jurisdiction to use U.S. laws and yet they are Chinese citizens (Rampell, 2007). Thus, Yahoo and Yahoo Hong Kong are not liable for violating the provisions of the ECPA.
The plaintiffs’ major argument is that their messages passed through the Yahoo servers in the U.S. before reaching their destination.
