A company offered, as an employee benefit, to allow employees to participate in the corporate cell phone contract with a major provider. The employees provided their own phones. The employer did not reveal that the records of calls and text messages would be available to employees in the accounting department. An employee in the accounting department noticed text messages being between a supervisor and an employee in the same department. The employee in the accounting department reported the exchanges to the Human Resources department which investigated and found the employees were dating in violation of company policy. Both employees were disciplined with a written warning. One of the employees later resigned and filed a suit against company for invasion of privacy.
