Case 10.5

The case relates to a patent where an individual was hired to develop a logo for a company. However, the company put several stipulations in the contract that would mean that the copyright and trademark were to belong to the company and not the artist. In contract law, there is a common adage that says, ‘a contract is a contract is a contract. The adage means that all stipulations that are included within a contract are enforceable regardless of whether either party to the contract does not like the consequences that the stipulations have on their interests 9 Helvacı, 2017).
