Stark ex rel. Jacobsen v. Ford Motor Co., 365 N.C. 468 (2012)

Facts: The case relates to products liability that was brought to the automobile manufacturer after child passengers suffered injuries following an accident. Mr. Stark and his children had been involved in an accident in 2003. Mr. Stark was driving whereas the children were in the back seat. The accident led to Cheyenne sustaining life-changing injuries and the plaintiff was thereby seeking compensation from Ford. In the case, the guardian had sued the company for product liability claiming that the manner in which the seatbelts had been developed was faulty and led to the accident. The plaintiffs claimed that Ford was at fault when making the seatbelts for children. The plaintiffs were demanding compensation due to the injuries that the children suffered. They asked for $25 million for Cheyenne and more than two hundred thousand USD for Cody.

Issue: Does the design of a product increase the liability of the manufacturer in case an individual suffers injuries?
