Abstract:
Modern legal systems typically link the insanity or diminished responsibility of an offender for a crime committed in the past to his future dangerousness. This nexus serves across legal systems as a justification for the indeterminate commitment of the offender with diminished or no criminal responsibility. Conceptually, however, insanity and risk are not related legal issues. Moreover, empirical research suggests that there is only a weak link between insanity, diminished responsibility and mental illness on the one hand and risk of recidivism on the other. Other risk factors seem to be more important. The inference of risk from insanity or diminished responsibility that lies at the heart of the indeterminate commitment of mentally disordered offenders is therefore problematic. This should lead to a reconsideration of the preconditions for indeterminate commitment of mentally disordered defendants.

Abstract:
This paper explores the role of medicine in the regulation of legal gender recognition for trans and gender diverse people in France and Italy. I focus on the processes that led the two countries to establish for the first time a procedure for legal gender change in the 1980s/1990s. Despite the differences, both in France and in Italy medical knowledge and technologies were embedded in the procedures for legal gender change and health professionals took a role as gatekeepers to gender recognition. The medicalization of legal gender recognition, I argue, was part of the deploying of a bio-political apparatus that aimed at regulating and controlling “gender transitions” through regulation and normalization rather then through repression.

Abstract (English):
The objective of this work is to learn about the most relevant aspects that characterize contemporary Legal Psychology throughout the study of journals included in the WoS between die years 2009 and 2014 related with the area of Psychology. The number of selected publications is 16, mainly from the USA and Great Britain. The results show an increase in the number of works and authors, a greater collaboration and a growth in medium productors. It exists a major presence of men in editorial boards and as authors, outstanding the figures of T. Ward in 2009 and A. Vrij in 2014. According to the analysis of key words the most relevant themes during these years have been Crime, Conduct, Woman and Meta-analysis, being sexual violence towards children and women and gender violence the criminal typology most studied. El objetivo del presente trabajo es conocer los aspectos más relevantes que caracterizan a la Psicología Jurídica contemporánea a través del estudio de las revistas de la WoS en los años 2009 y 2014 relacionadas con esta área de la Psicología. Abstract:
The aim of this paper was to create a decision tree (DT) to identify personality profiles of offenders against public safety. A technique meeting this requirement was proposed that uses the C4.5 algorithm to derive decision rules for personality profiling of public safety offenders. The Mini-Mult test was used to measure the personality profiles of 238 individuals. With the test results as our database, a C4.5 DT was applied to construct rules that classify each profile into one of two groups, those without and those with records of offences against public safety. The model correctly classified 80% of the personality profiles and delivered a set of decision rules for distinguishing the profiles by group, and the principal personality profiles were interpreted. We conclude that DTs are a promising technique for analysing personality profiles by their offender or non-offender status. Finally, we believe that the development of a classifying model using DT may have practical applications in the Colombian prison system. Copyright © 2016 John Wiley & Sons, Ltd. Abstract:
Since the mid-nineteenth century, psychiatrists and psychologists have struggled to conceptualise a group of behaviourally disturbed subjects who repeatedly engage in exploitative and violent acts. In 1941, Cleckley first operationalised the construct of psychopathy in The Mask of Sanity. In 1980, Hare produced a checklist for a more formalised, categorical definition of psychopathy. The subsequent 20 item Psychopathy Checklist-Revised (PCL-R) purports to identify a select population of callous and remorseless individuals who appear to have a specific defect of emotional processing and be generally insensitive to the negative consequences of their risky or criminal behaviour. Operationalising the construct of psychopathy continues to evolve. Whilst the utility of the construct of psychopathy to generally predict violence and recidivism has important public policy implications in the management of serious offenders, compelling sociological and ethical issues arise particularly when courts propose to apply idiographic and prescriptive outcomes on the basis of nomothetic expert opinion on future behaviour based on measures of a construct of psychopathy. Abstract:
In common law jurisdictions, legal professionals cite facts and legal principles from precedent cases to support their arguments before the court for their intended outcome in a current case. This practice stems from the doctrine of stare decisis, where cases that have similar facts should receive similar decisions with respect to the principles. It is essential for legal professionals to identify such facts and principles in precedent cases, though this is a highly time intensive task. In this paper, we present studies that demonstrate that human annotators can achieve reasonable agreement on which sentences in legal judgements contain cited facts and principles (respectively, $$\kappa =0.65$$ and $$\kappa =0.95$$ for inter- and intra-annotator agreement). We further demonstrate that it is feasible to automatically annotate sentences containing such legal facts and principles in a supervised machine learning framework based on linguistic features, reporting per category precision and recall figures of between 0.79 and 0.89 for classifying sentences in legal judgements as cited facts, principles or neither using a Bayesian classifier, with an overall $$\kappa$$ of 0.72 with the human-annotated gold standard.
