After viewing the first two videos write a summary of the exclusionary rule in terms of purpose, historical development, amendments and the concept of “fruits of the poisonous tree”. Then view the third video and define, compare, and contrast a stop with an arrest providing examples of each based on reading material and videos.
Exclusion rule refers to a legitimate statutory decree, which is responsible for preventing the violation of individual rights. Under exclusion rule, the evidence obtained from a crime scene is not permissible if not obtained in the correct procedure. Therefore, under exclusion rule, the state cannot use the evidence collected illegally in the court of law. The state must follow the proper methods of obtaining evidence or have a probable cause to investigate a person or a place of crime.
