There exists two distinct issues involving the investigation of economic espionage and trade secret misuse; they constitute approaches that the law enforcers employ in the investigations. The first issue as stipulated in the United States Attorney’s Manual is the depth of the criminal activity and the proof of a foreigner’s involvement. The Economic Espionage Act has two distinct provisions for divergent but related offences. The first provision involves the misuse of a trade secret intended to financially advantage a foreign government, entity or a agency.
The other provision involves the misuse of a trade secret so as to converting the trade secret into a financial gain for a different entity rather than the holder of the trade secret (Mossinghoff, Mason, & Oblon, 1997).
